Terms of Service

1. Acceptance of Terms

By accessing or using the Tracck platform, available at tracck.net and related subdomains (the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not use the Platform. These Terms apply to all users including coaches, athletic directors, school administrators, meet directors, athletes, and parents.

2. Description of Services

Tracck LLC ("Tracck," "we," "us," or "our") provides an athletic competition management platform designed for track and field and cross country programs at the middle school and high school levels. Our services include, but are not limited to:

  • Athlete roster and performance management
  • Meet creation, event configuration, and entry management
  • Automated heat and lane seeding
  • Live result entry and team scoring
  • Public results publishing via Tracck Timing
  • Professional timing services (on-site, where booked separately)
  • Merchandise store powered by Tracck

3. Eligibility & Account Registration

To create an account on Tracck, you must be at least 18 years of age, or a school official (coach, administrator, or meet director) authorized to manage student records on behalf of your institution. By registering, you represent and warrant that:

  • All information you provide is accurate and complete
  • You have the legal authority to enter into these Terms on behalf of yourself or your school
  • You will maintain the confidentiality of your account credentials
  • You will notify us immediately of any unauthorized use of your account

Tracck reserves the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used inappropriately.

4. Student Data & FERPA Compliance

Tracck takes student privacy seriously. The following terms govern the handling of student information on our Platform:

  • School Responsibility: Schools and their authorized staff are responsible for ensuring they have obtained any necessary parental or student consents before entering student information into the Platform, in accordance with the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g.
  • Authorized Use Only: Student data entered into Tracck may only be used for legitimate athletic management and educational purposes. Misuse of student data is strictly prohibited.
  • No Sale of Student Data: Tracck will never sell, rent, or trade student personally identifiable information (PII) to third parties for any commercial purpose.
  • Data Minimization: Only the minimum necessary student information required to operate athletic programs should be entered into the Platform.
  • Public Results: Athletic performance results (name, school, event, result) may be displayed publicly. This is consistent with standard athletic community practices and is treated as "directory information" under FERPA when properly designated by the school. Coaches may request removal of specific athletes' information at any time.
  • Minors Under 13: Tracck accounts must be managed by adults. Coaches and administrators entering data for athletes under 13 are responsible for compliance with the Children's Online Privacy Protection Act (COPPA).

5. Acceptable Use

You agree to use the Platform only for lawful purposes. You may not:

  • Upload false, fraudulent, or misleading athlete or meet information
  • Attempt to gain unauthorized access to any part of the Platform or another user's account
  • Use automated scripts, bots, or scrapers to access the Platform without our written consent
  • Harass, threaten, or harm other users
  • Upload or transmit malware, viruses, or any harmful code
  • Use the Platform to advertise or solicit unrelated commercial services
  • Violate any applicable federal, state, or local law or regulation
  • Interfere with or disrupt the integrity or performance of the Platform

6. Intellectual Property

All content on the Platform, including text, graphics, logos, software, and data compilations, is the property of Tracck LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Platform content without our express written permission. You retain ownership of any athlete or meet data you enter, and by using the Platform you grant Tracck a limited, non-exclusive license to store, display, and process that data solely to provide the services described herein.

7. Timing Services & Bookings

Professional on-site timing services are offered separately through Tracck Timing and are subject to a separate service agreement confirmed upon booking. Booking requests submitted through the Platform are not binding until confirmed in writing by Tracck. Tracck reserves the right to decline or cancel bookings at its discretion, in which case any prepaid fees will be refunded in full. Service availability is limited and subject to staff and equipment availability.

8. Store & Merchandise

Merchandise sold through the Tracck store is fulfilled by a third-party print-on-demand provider. All sales are final unless the item is defective or incorrect. Shipping estimates are provided by the fulfillment provider and are not guaranteed. By placing an order, you authorize Tracck to charge the total amount including applicable taxes and shipping fees. Refund and dispute requests must be submitted to support@tracck.net within 14 days of delivery.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Tracck does not warrant that the Platform will be error-free, uninterrupted, or free of harmful components. Your use of the Platform is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by law, Tracck LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, even if advised of the possibility of such damages. Tracck's total liability to you for any claim arising under these Terms shall not exceed the greater of (a) $100 USD or (b) the amount you paid to Tracck in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tracck LLC and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any applicable law or the rights of any third party, including student privacy rights.

12. Termination

Tracck may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimer of warranties, limitation of liability, and indemnification) shall survive.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of [Your State], without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Platform shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration under the American Arbitration Association's Commercial Arbitration Rules. You waive any right to a jury trial or class action proceeding.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or a prominent notice on the Platform at least 14 days before the new Terms take effect. Continued use of the Platform after the effective date constitutes your acceptance of the updated Terms.
